Terms of Service

These Terms of Service (the "Terms") govern the use of the Cookiestack cookie consent management service (the "Service"). The Service is provided by SIA Workline Labs, registration No. 40203793393 (the "Provider"). By registering an account or using the Service, the customer (the "Customer") agrees to these Terms.

1. The Service

The Service is a platform for managing cookie consent on the Customer's websites: a consent banner, automatic cookie scanning, a visitor consent log and Google Consent Mode v2 integration — to the extent of the selected plan.

2. Account

The Customer provides accurate information when registering and is responsible for keeping their credentials secure and for all activity in the account. The Service is intended for businesses and individuals acting in a business or professional capacity.

3. Plans and payment

Current plans and prices are published on the Service website. The Free plan is provided free of charge within its stated limits. Paid plans are activated at the Customer's request and invoiced in euros (EUR). Unless agreed otherwise, fees are paid in advance for each billing period (one month). Value added tax is applied in accordance with applicable law.

The Customer can cancel a paid plan at any time from the dashboard. After cancellation, plan access continues until the end of the current period. The Provider gives at least 30 days' notice of price changes.

4. Customer obligations

• The Customer is the controller of their website visitors' personal data and is solely responsible for the content of their privacy and cookie policies, banner configuration and the accuracy of legal wording;
• the Service is a technical tool for collecting consent and does not replace legal advice;
• the Customer does not use the Service for unlawful purposes and does not interfere with its operation.

5. Processing on the Customer's behalf

For the consent records of visitors to the Customer's websites, the Provider acts as a processor within the meaning of Art. 28 GDPR and:

• processes the data only to provide the Service and on the Customer's documented instructions, given through the Service settings;
• ensures that persons with access to the data are bound by confidentiality;
• implements appropriate technical and organizational security measures (including pseudonymization of IP addresses);
• engages sub-processors (hosting, email delivery) only under equivalent data protection obligations;
• assists the Customer with data subject requests and notifies personal data breaches without undue delay;
• deletes the respective data when the Service ends, unless the law requires retention.

6. Availability and liability

The Provider uses reasonable efforts to keep the Service available but does not guarantee uninterrupted operation. The Provider is not liable for fines or damages arising from the Customer's incorrect banner configuration or failure to meet other data protection requirements. To the extent permitted by law, the Provider's total liability does not exceed the amount the Customer paid for the Service in the preceding 12 months.

7. Term and termination

These Terms remain in effect until the Customer deletes their account or either party stops the use of the Service. The Provider may suspend an account for a material breach of these Terms. Fees for a period that has already started are not refundable, except where required by law.

8. Governing law

These Terms are governed by the laws of the Republic of Latvia. Disputes are resolved by negotiation and, failing agreement, by the courts of the Republic of Latvia. The Provider may amend these Terms and will notify the Customer of material changes by email at least 30 days in advance.
